AR-News: (AU) Court blunder over kitten killers

A COURT blundered when sentencing six Townsville soldiers for torturing
and killing kittens, it has been revealed.

The magistrate hearing the case was wrongly informed by the prosecution
that the maximum penalty for the crime was about $14,000 – $61,000 less
than prescribed.

RSPCA chief executive officer Mark Townend said the soldiers might have
received a bigger fine if the magistrate knew the true maximum penalty.

"Maybe this is enough grounds for the police commissioner to launch an
appeal," Mr Townend said.

The soldiers – Ben Charles David Lightbody, 21; Brett Michael Henry
Neville, 26; Casey Mitchell Parker, 21; Geoffrey Martin Symonds, 20;
Darryl Stephen Llewellin, 26; and Christopher James Murray, 19 – appeared
in Townsville Magistrates Court on May 10 and pleaded guilty to animal
cruelty.
