News from Covance Campaign – May 2004

Covance recently had the World Intellectual Property Organisation (WIPO) 
mediate
over a legal dispute involving the domain name
used by us at the Covance Campaign, their reasoning was that our web domain 
name
and theirs were too similar for comfort and might
mislead their customers into believing that the Covance Campaign site was 
run or
endorsed by Covance themselves.

After having spent £1500 getting a legal team in the Netherlands put 
together
their complaint against us they then spent an
undisclosed amount to have the WIPO in Geneva mediate over the case. The 
Covance
Campaign was not eligible for legal aid as the
case was one of corporate law rather than criminal law and so had to defend
itself and prepare its own response to Covance's
complaint.

Amid the countless complaints aimed at us the one overriding concern of
Covance's was the similarity of our domain name to theirs,
all other complaints were seemingly there to prop up this particular one. If
they had won (and recent WIPO case history seems to
indicate that similar sounding web domains DO often result in the site being
transferred to the complainant) this would perhaps
have set a president for other similar legal challenges to grassroots 
campaigns,
happily they didn't and at some point in the near
future we expect a full written report from the WIPO as to why Covance 
failed.

Finally lets round off by saying:
Covance legal challenge: £1500+
Covance Campaign legal defence: £6 on post and photocopies
Result: less cash to spend on killing animals
Cost - Priceless!

Animal experiments have:
a 63% failure rate when detecting human carcinogens
a 75-95% failure rate for detecting drug side effects
a 70% failure rate for detecting drugs which cause birth defects
Success rates lower than those achieved by uneducated guesswork.

This is not science!!
