We are also thrilled that People for the Ethical Treatment of Animals

Dirty Secrets - household products testing
The BUAV is making cleaning your house with a clean conscience easier with
the Humane Household Products Standard (HHPS) and we're pleased to announce
that Co-op's own-brand range has now been BUAV approved (see full list
below). The Standard's "leaping bunny" logo will start appearing on
products, making it easy for consumers to go cruelty-free.
If you haven't done so already, don't forget to contact your MP and urge
them to sign the BUAV's Early Day Motion (EDM: 738) calling on the
Government to introduce a ban on animal testing for household products. So

LEGAL BASIS FOR BANNING CAT AND DOG FUR IN THE EU
Following is a summery of a legal opinion very recently produced by UK
barristers Philippe Sands QC and Kate Cook of Matrix Chambers, both
experts in EU and international law on behalf of the Humane Society of
the US/Humane Society International and Respect for Animals outlining
why it is within European Commission competence to ban cat and dog furs
and skins in the European Union.
In summary:
o There is a good argument that Article 4(4) of Regulation (EC)
No. 1774/2002 (animal by-products) already provides a basis for the
European Union to adopt rules to regulate the import and export of cat
and dog fur taken from any member of a domestic species.
o The EU has competence under Article 95 of the EC Treaty to
legislate for a ban on the production and sale within the EU of cat and
dog fur on the basis that such a measure is necessary to remove an
obstacle to the functioning of the internal market (current and pending
disparities in national law on whether such products may be produced or
sold). A measure adopted under Article 95 should take account of animal
welfare, public health and consumer protection concerns which reinforces
the argument for a ban in trade in cat and dog fur.
o The EU has competence to ban external trade (import and export)
of such fur under Article 133(ex 113).
o On a preliminary view such a ban would be compatible with the
rules of the WTO on the basis that, although it would be likely to
constitute a restriction on trade contrary to Article XI.1 of the GATT,
it is strongly arguable that it could be justified under Article XX (a)
on grounds that it is a measure necessary to protect public morals (or
possibly XX(b) a measure necessary to protect the health of animals) and
is not being applied in a discriminatory manner nor as a disguised
restriction on international trade. The Commission accepts that there is
no WTO problem provided the EU can - as we have now been advised is the
case - ban the internal trade in cat and dog fur. The US Also believes
there is no WTO obstacle.
Background
In 1998, the Humane Society of the US (HSUS), America's largest animal
protection organization undertook an 18 month investigation into the
cruel raising and inhumane slaughter of millions of cat and dogs in Asia
solely for their furs and skins. Close to 2 million animal skins and
furs were being shipped to the US, EU and Russia in clothing and other
articles. Consumers had no way of knowing this because Asian dealers
utilized fraudulent labeling, dyed items to resemble faux fur or did not
label them at all. The US Congress banned the fur in 2002. Most of the
Asian trade appears to have shifted to the European Union to make up for
lost revenues. Along with fraud, some of the fur items have tested
positive for excessive levels of chromium. Both the majority of the
European Parliament (1999-2004) and the Council of Agriculture Ministers
want a ban in Europe.
The European Commission has refused to implement such a ban, claiming it
lacks legal authority and this should be handled solely by national
governments. The legal opinion demonstrates why this view is wrong.
