MUNCIE - Supporters seeking leniency for Abel Alves and Carol Blakney
packed Delaware Circuit Court 5's courtroom Tuesday afternoon.
The sentence issued by Judge Wayne Lennington couldn't have been any
softer: a $1 fine, an apology, no jail time, no probation, no community
service.
"I'm sorry we're here," Lennington said. "I'm sorry it wound up in
criminal court. My sentence is the only fair thing to do."
A six-member jury last month convicted Alves, a noted professor of history
at Ball State University, and his wife, Carol Blakney, an artist, of
trespassing at Seldom Rest hog farm on Oct. 12, 2002.
Alves and Blakney are environmental/animal rights activists.

Both defendants plan to appeal their class A misdemeanor convictions,
which carried maximum penalties of one year in jail and a $5,000 fine.

More than 20 people, including faculty and administrators from Ball State,
Allegheny College, University of Massachusetts and UCLA, sent the judge
letters urging leniency, and other backers were in court to testify.
