WHEREAS the Board of Chosen Freeholders is aware of recent public concern regarding the potential for encounters between Black Bears and humans in portions of Passaic County and elsewhere in the northwestern part of the State of New Jersey; and
WHEREAS the State of New Jersey has established, through the Department of Environmental Protection, Division of Fish and Wildlife, has a Black Bear Hunting Season to commence on December 8, 2003 and terminate on December 13, 2003; and
WHEREAS the State has delineated a Black Bear Hunting Area consisting of portions of several counties in the Northwest portion of the State, including areas within the County of Passaic located west of Route 287;
WHEREAS the Board of Chosen Freeholders of the County of Passaic believes that the proposed bear hunt will be an unnecessary, inhumane and ultimately ineffective tool for managing the bear population in the State, and has previously gone on record as opposing such a hunt by way of a resolutions dated July 11, 2000 (R-00-392) and June 11, 2003 (R-03-325); and
WHEREAS the Board is also concerned about the potential safety hazards attendant to the Black Bear Hunt, and is desirous of prohibiting hunting activity on all lands owned by the County of Passaic; and
WHEREAS the Board is authorized by N.J.S.A. 40:32-7.12 to adopt rules and regulations concerning permitted uses of its public lands for recreational purposes, and to establish fines and penalties for the violation such rules and regulations;
NOW THEREFORE BE IT RESOLVED by the Board of Chosen Freeholders of the County of Passaic that it hereby prohibits hunting activity on any and all lands owned by the County of Passaic, and that all such lands be immediately posted accordingly; and
BE IT FURTHER RESOLVED that violations of this regulation shall be punishable by such fines and penalties as are provided by applicable law, and prosecuted in accordance with the provisions of N.J.S.A. 40:32-7.13 and 40:32-7.14; and
BE IT FURTHER RESOLVED that a certified copy of this resolution be forwarded to Governor James E. McGreevey, the Commissioner of Environmental Protection, and the Director of the Division of Fish and Wildlife.
