AR-News: (US) Dog-killing verdict upheld in court - Man can't blame Leo for running into path of minivan

A San Jose man who flung Leo the dog into traffic in an act of road rage
that drew worldwide attention cannot blame the terrified bichon frise for
running in front of an oncoming car, a state appeals court has ruled.

The state Court of Appeal in San Jose upheld the animal cruelty conviction
of Andrew Douglas Burnett, who tossed the tiny dog into traffic near San
Jose International Airport on a rainy evening in February 2000.

Burnett had argued that the fluffy white dog had a part in its own demise.
After almost making it to the other side of the road, the dog, he argued,
inexplicably decided to turn around and run back into the road.

The three-judge panel called his reasoning absurd.
